Terms of Service
Last updated: September 8, 2026
These Terms of Service ("Terms") govern your use of the Apex UST Testing website and the associated customer/employee portal (together, the "Service"), operated by Apex UST Testing ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms.
The Service
The Service provides underground storage tank (UST) testing scheduling, compliance tracking, testing results and reports, invoicing visibility, and messaging between customers and our staff.
Accounts
Accounts are provisioned by Apex UST Testing for our customers and staff. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at the email below if you suspect unauthorized access.
Acceptable use
You agree not to use the Service to:
- Access data belonging to another company or user without authorization;
- Interfere with or disrupt the Service or its infrastructure;
- Use the Service for any unlawful purpose.
QuickBooks Online integration
The Service integrates with QuickBooks Online, a service provided by Intuit Inc., to import invoices from Apex UST Testing's own QuickBooks Online account into the portal. This integration is between Apex UST Testing and its own QuickBooks Online company — customers do not connect an account of their own. The integration is read-only: the Service does not create, modify, or delete data in the connected QuickBooks Online account.
Invoicing and payment
Invoices displayed in the Service, including those synced from QuickBooks Online, are provided for informational purposes as part of the Service. Billing and payment terms for testing services are governed by your underlying service agreement with Apex UST Testing, not by these Terms.
Testing results and compliance
Testing results and compliance documentation provided through the Service are intended to support, not replace, your own compliance obligations under applicable federal and state regulations (including EPA and Virginia DEQ requirements). You remain responsible for your facility's regulatory compliance.
Disclaimer and limitation of liability
The Service is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, Apex UST Testing is not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
Termination
We may suspend or terminate access to the Service for any account that violates these Terms or for legitimate business reasons, with notice where practicable.
Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above.
Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles.
